By using the website and online shop www.pantriswswen.co.uk to place orders the buyer is bound by the terms and conditions herein according to and in compliance with the laws of England and Wales. The seller may change the terms and conditions at any time, do not assume that the same terms and conditions of sale apply to future orders.

1 Products

1.1 All the information on the website is intended for guidance only, images are used for illustration purposes only and product and product appearance may differ slightly from those shown.

1.2 Products and prices are subject to change without notice, the website is regularly updated.

1.3 The seller manufactures products in a facility that uses nuts. Allergens are listed on the product page description and on individual product labels. Further advice on the allergens that may be included in the products can be obtained via the contact us page.

1.4 Products are made using seasonal ingredients with key ingredients used in each product grown or/and produced in Wales.

1.5 All products are made by hand by the seller in Wales.

1.6 Due to the seasonal nature of our products there may be occasions where a product is not available. The seller reserves the right to substitute items of a similar or greater value to fulfil the buyers order. The seller will always endeavour to contact you first before despatch to advise on the change. The seller will not be liable to the buyer for any failure to supply products or for any inaccuracies in contact details the buyer has provided to the seller.

2 Order payment and delivery

2.1 By using The sellers website and online shop to place orders the buyer is bound by the terms and conditions herein according to and in compliance with the laws of England and Wales. The seller may change the terms and conditions at any time, do not assume that the same terms apply to future orders.

2.2 The buyer should only use this website if they are aged 18 years or above. If the buyer is under the age of 18 they should use the website only with the supervision of an adult. Payment information must be provided by or with the permission of an adult.

2.3 Placement of an order through the website by the buyer does not constitute a contract of any kind with the seller until the order has been received, accepted and payment has been made in full to the seller. A confirmation email will be sent by the seller to the buyer at the point the order has been accepted. Goods remain the property of the seller until paid in full.

2.4 The seller can only accept orders for delivery in the UK at this time, the seller is unable to deliver outside of the UK.

2.5 Time is not of the essence for delivery. The seller will provide an estimated delivery date but can not be held liable for deliveries that are made either early or late.

2.6 The seller will make a reasonable attempt to contact the buyer if any difficulty fulfilling the buyers delivery is expected. In the event of non-delivery the buyer must inform the seller within 5 working days. The sellers liability to the buyer will be limited to the price of the goods not delivered and the cost of delivery following review and acceptance by the seller.

2.7 The seller can not be held liable for non-delivery due to the recipient not being available or not contacting the carrier following a failed delivery to arrange collection or re-delivery. The seller can not be held responsible for goods that are damaged or lost as a result of the recipient not being in to receive the delivery.

2.8 Following order acceptance the seller will endeavour to make delivery within 3 working days (Monday to Friday excluding Bank Holidays and weekends).

2.9 Christmas and New Year delivery dates will be advertised on the website. Deliveries during this time can not be guaranteed.

3 Order alterations, cancellations & returns

3.1 Alterations and cancellations requested in writing by the buyer may be agreed by the seller subject to the order stage and will be assessed on an individual order basis taking into consideration the nature of the order. Notification from the buyer to the seller must be made by email and will only be considered accepted via email confirmation from the seller to the buyer. Additional cancellation charges may apply which the seller will inform the buyer of in a timely manner.

3.2 For non-perishable products the buyer has the right to cancel the contract at any time until the expiry of the 7th working day after the date of delivery of goods by notifying the seller in writing by email. In the case of perishable items the buyer does not have the right to cancel the contract. The cancellation policy does not affect the buyers rights when the seller is at fault, for example if the goods are faulty or misdescribed.

3.3 The seller is required by law to refund the buyer for the full cost of the delivery charge within 30 days of notifying the seller of cancellation. However, the seller expects to have usually refunded the payment to the buyer sooner than 30 days. Cancellation acceptance is dependent on the stage at which the cancellation of the order has been received by the seller. Cancellation prior to the seller issuing an order confirmation is acceptable. However, if the seller has commenced order processing there may be additional charges to be considered, the seller will advise the buyer of any charges or costs for cancellation at the point of the cancellation acknowledgement.

3.4 Following delivery, If the buyer is not satisfied with the products or the goods have arrived damaged the seller must be notified by the buyer by email within 24 hours following receipt of the order. The buyer must email the seller advising why they are not satisfied. If the seller agrees the query raised is valid the goods need to be assessed by the seller before a final decision is made on the action required. The buyer must return the goods in the original packaging to the seller by recorded delivery at the buyers cost within 3 days following receipt of the sellers’ notification to return the goods for further inspection and review. If the seller agrees that the products or service provided is not satisfactory the seller may replace the goods or provide a refund to the value of the goods. The seller reserves the right to deduct the cost of the original delivery charge from the refund. The seller is not liable to refund the cost of the buyers return postage costs. The goods are returned entirely at the buyers cost. The seller may charge delivery cost to the buyer for the replacement goods, payment in full by the buyer will be required before the goods are resent subject to delivery times.

4 Payment

4.1 The seller is entitled to payment in full for the price of goods and services on the date that the buyers order is placed. The seller reserves the right to terminate the contract with the buyer if the seller is refused authorised payment or reasonably believes that payment will be refused at any stage.

4.2 If a failed payment occurs, the buyer agrees to compensate the seller in full against all reasonable costs, expenses and outgoings incurred by the seller in their attempt to obtain payment from the buyer. This may incur administrative charges of not less than £15 for consumers, and where the order is placed by a business this will incur late payment interest at 8% plus the bank of England interest rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 plus reasonable costs to recover the debt.

5.1 The website design, text, images, graphics, content and the selection and arrangement on the website is the copyright of the seller. Permission is granted to electronically copy and print portions of the website for the sole purpose of placing an order through the seller or to use the website as a shopping resource. Any and all other use of the materials on the website including reproduction purposes other than those noted in the terms and conditions, modification, or re-publication of any part without the prior written permission of the seller is strictly prohibited.

These terms and conditions will not affect consumer statutory rights and are in accordance with and construed by the laws of England and Wales.
